The United States Court of Appeals for the Second Circuit, based in New York City, has rendered a decision that will impact prosecutions that result from multi-jurisdictional investigations.

New Westminster – We are pleased to the announce our victory today in which our client was found not guilty of importation of 23 kilograms of cocaine and possession for the purposes of trafficking, after a full trial in New Westminster Supreme Court. The cocaine was valued at $1 million whole sale and had a street value of $2.3 million.

Vancouver – We are pleased to announce our successful appeal of a $7.3 Million disgorgement order made by the BC Securities Commission against our clients. The unanimous ruling of a three justice panel of the British Columbia Court of Appeal was released this morning.

The interception of private communications, or wiretaps, are becoming increasingly common in the context of white collar crime investigations. For instance, in the United States wiretaps have been used in prosecuting insider trading cases and in Canada, have now been used in the context of prosecutions under the Corruption of Foreign Public Officials Act. What was once a tool used primarily for organized crime cases, has evolved into the investigation of white collar crime cases.
